1.1 These Terms & Conditions ("Terms") govern your access to and participation in events organized under the "Rugged Rush" brand, including but not limited to obstacle course races, and your use of the website located at ruggedrush.com (the "Website").
1.2 Rugged Rush is a jointly owned intellectual property of Paper Mache Private Limited (CIN: U92490DL2021PTC390547), a company incorporated under the Companies Act, 2013, having its registered office at D-2/7, Jeewan Park, Uttam Nagar, South Delhi, Delhi, India, 110059, and Spike Experience Private Limited (CIN: [CIN NUMBER]), a company incorporated under the Companies Act, 2013, having its registered office at [REGISTERED ADDRESS] (together, "Rugged Rush", "we", "us", or "our").
1.3 By registering for an event, purchasing a ticket, creating an account, or otherwise using the Website, you ("Participant", "you") agree to be bound by these Terms, our Privacy Policy, and any event-specific rules communicated to you. If you do not agree, you must not register for or participate in any Rugged Rush event.
1.4 We may amend these Terms at any time. The version in force at the time of your registration governs your participation in that specific event. Material changes will be notified via the Website or email where practicable.
2.1 Participants must be at least 16 years old to register independently. Participants between the ages of 16 and 18 may register only with the written consent of a parent or legal guardian, who must countersign the waiver in Section 8.
2.2 By registering, you confirm that: (a) all information provided during registration is true, accurate, and complete; (b) you are medically fit to participate in a physically demanding obstacle course event (see Section 8.4); (c) you are not participating in violation of any law or any order of a court or authority applicable to you.
2.3 We reserve the right to refuse or cancel any registration at our sole discretion, including where eligibility criteria are not met, with a refund handled per Section 6.
3.1 Registration is confirmed only upon receipt of full payment through our designated payment partner(s) (currently Razorpay and/or Townscript) or upon confirmation from an authorized co-organiser.
3.2 Prices displayed are exclusive of applicable taxes (including GST) unless stated otherwise, and are subject to change without notice until payment is completed.
3.3 It is your responsibility to ensure the accuracy of your registration details (name, category, city, contact information) prior to submission. Bib/category changes after registration may be subject to an administrative fee and are not guaranteed.
3.4 Race kits, timing chips, and any other registration inclusions will be distributed as per the process communicated closer to the event date. We are not responsible for kits uncollected due to Participant's failure to attend distribution as scheduled.
3.5 Team and corporate registrations (see our Corporate packages) are additionally governed by the specific commercial terms agreed in writing with the corporate client.
4.1 Participants must: (a) follow all instructions given by race marshals, volunteers, medical staff, and event officials at all times; (b) not participate under the influence of alcohol or any prohibited substance; (c) not engage in conduct that endangers themselves, other participants, spectators, or event staff; (d) not damage, deface, or misuse event infrastructure, obstacles, or venue property.
4.2 We reserve the right to remove any Participant from the event, without refund, for violation of this Code of Conduct or for conduct that we, in our sole discretion, consider unsafe or inappropriate.
5.1 Bib transfers to another individual may be permitted up to 10 days before the event, subject to an administrative fee, and only through the official process communicated by us. Unauthorized transfers or resale of bibs ("bib mules") are strictly prohibited and will result in disqualification of both parties without refund.
6.1 Participant-initiated cancellation. Registration fees are non-refundable if you choose to withdraw or are unable to attend for any personal reason. Refunds are applicable only in the circumstances set out in Sections 6.2 and 6.3 below.
6.2 Event postponement by Rugged Rush. If an event is postponed, your registration will automatically carry forward to the rescheduled date at no additional cost. If the rescheduled date is unsuitable for you, you may request a refund, subject to a processing fee of [X]%, within [X] days of the postponement announcement.
6.3 Event cancellation by Rugged Rush. If an event is cancelled entirely and not rescheduled, you will be entitled to a full refund, less any non-recoverable third-party costs (e.g., payment gateway fees), unless the cancellation is due to a Force Majeure event (Section 11), in which case Section 11.2 applies.
6.4 We do not offer refunds for late arrival, failure to complete the course, disqualification under Section 4, or voluntary withdrawal after the event has commenced.
6.5 Processing fees charged by our payment partners are non-refundable.
7.1 Rugged Rush events take place outdoors and are subject to weather and terrain conditions beyond our control. We reserve the right to modify, shorten, or reroute the course, or suspend the event temporarily, for safety reasons without liability, and such modification does not entitle you to a refund.
8.1 Inherent Risk. Participant acknowledges that an obstacle course race is a physically strenuous activity involving inherent risks, including but not limited to falls, collisions, muscle strain, dehydration, cuts, fractures, and in rare cases, severe injury or death. These risks exist even where we and our staff exercise reasonable care.
8.2 Voluntary Participation. Participant voluntarily assumes all such risks, known and unknown, arising from participation, and confirms that no assurance of safety has been given beyond what is stated in these Terms.
8.3 Release. To the maximum extent permitted by applicable law, Participant releases and discharges Rugged Rush, Paper Mache Private Limited, Spike Experience Private Limited, their officers, employees, volunteers, sponsors, and venue partners (collectively, the "Released Parties") from any and all claims, demands, and causes of action arising from participation in the event, EXCEPT to the extent such claims arise from the gross negligence or wilful misconduct of the Released Parties, which cannot be excluded under Indian law.
8.4 Medical Fitness Declaration. Participant confirms that they have no medical condition that would make participation unsafe, and that they have consulted a physician if they have any doubt about their fitness to participate. Participant is solely responsible for disclosing any relevant medical condition (e.g., cardiac, respiratory, or musculoskeletal) at registration or at the venue medical desk.
8.5 Emergency Medical Treatment. In the event of injury, Participant consents to receive first aid or emergency medical treatment from on-site medical staff, and to be transported to a hospital at Participant's own cost if the on-site medical team deems it necessary.
8.6 Insurance. Participants are responsible for their own medical/accident insurance. Rugged Rush does not provide event insurance covering Participant injury, and Participant's participation in the event is at their own financial risk in this regard.
8.7 Minors. Where a Participant is a minor permitted to register under Section 2.1, the parent/legal guardian executing the waiver on the minor's behalf additionally agrees to indemnify the Released Parties as set out in this Section 8 on behalf of the minor.
9.1 Rugged Rush and its authorized photographers/videographers may capture images and video of Participants during the event for use in marketing, promotional, social media, and archival purposes, across all media formats, in perpetuity, without compensation to Participant.
10.1 The "Rugged Rush" name, logo, and all associated trademarks are the joint property of Paper Mache Private Limited and Spike Experience Private Limited. All content on the Website, including text, graphics, race maps, and obstacle designs, is protected by copyright and may not be reproduced without our prior written consent.
11.1 We shall not be liable for any failure or delay in performance of our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including natural disaster, extreme weather, pandemic, government order, strikes, or civil unrest ("Force Majeure Event").
11.2 In the event of cancellation due to a Force Majeure Event, refunds (if any) will be at our discretion and will account for costs already irrevocably incurred by us in organizing the event.
12.1 To the maximum extent permitted under applicable law, and subject to Section 8.3, the aggregate liability of the Released Parties arising out of or in connection with an event or these Terms shall not exceed the registration fee paid by the Participant for that event.
12.2 We shall not be liable for any indirect, incidental, or consequential loss, including loss of income or travel/accommodation costs incurred by Participant in connection with the event.
13.1 Participant agrees to indemnify and hold harmless the Released Parties from any claim, loss, or damage (including reasonable legal costs) arising from Participant's breach of these Terms or Participant's wrongful act or omission during the event.
14.1 These Terms are governed by the laws of India. The courts at Delhi shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology (Intermediary Guidelines) Rules, 2021, grievances regarding the Website or an event may be addressed to:
